Partner Visas – Subclasses 820 and 801

The Partner Visas (Subclasses 820 and 801) allow the spouse or de facto partner of an Australian citizen, Australian permanent resident, or eligible New Zealand citizen to live in Australia.

Applicants generally apply for both visas together:

Subclass 820: Temporary Partner Visa
Subclass 801: Permanent Partner Visa

The Subclass 820 visa allows the applicant to remain in Australia while the permanent Subclass 801 stage is being assessed.

Basic Eligibility

Applicants generally need to:

Be married to or in a genuine de facto relationship with an Australian citizen, Australian permanent resident, or eligible New Zealand citizen
Have an eligible partner sponsor the application
Be in Australia when applying
Be at least 18 years old in most circumstances
Provide evidence that the relationship is genuine and continuing
Live together or not live separately on a permanent basis
Meet health and character requirements
Satisfy relevant visa-history requirements

De facto partners generally need to show that the relationship existed for at least 12 months before applying, unless an exemption applies.

The history and development of the relationship
Social recognition of the relationship
Mutual commitment to a shared life
Future plans as a couple

Can Family Members Be Included?

A dependent child may generally be included when the temporary application is lodged or added before the Subclass 820 decision is made.

Family members included in the application must meet the relevant health and character requirements and generally need to be in Australia when applying with the main applicant.

Where Must the Applicant Be?

The applicant and accompanying family members must generally be in Australia when the application is lodged. The applicant may be inside or outside Australia when the temporary Subclass 820 decision is made.
